1. Validity of the General Terms and Conditions
These Terms and Conditions apply to all contracts concluded via the online shop “ hi1-golf.com ” between AFG Healthcare GmbH and a consumer. A consumer is any natural person who acts in business transactions for purposes that cannot be attributed to their professional or commercial activity. Our range of goods in the online shop is aimed exclusively at consumers who have their usual place of residence and a delivery address in Austria.2. Acceptance of the Terms and Conditions
The customer acknowledges these General Terms and Conditions – in the version valid at the time the order is placed – and agrees to them as soon as the respective order is placed.3. Conclusion of contract
a. Internet presence of AFG Healthcare GmbH
The product presentation on the website does not constitute a binding offer in the legal sense. It is an invitation to the customer to make an offer themselves. You, as the customer, make the offer in the legal sense by placing the order by clicking the "Buy now" button after completing the order process. You remain bound to this order for 2 weeks, i.e. the contract is binding if we accept your order within this period. Confirmation of receipt of the order is sent immediately after it has been sent by an automated email. We declare acceptance of the contract by a separate email as soon as the goods leave our warehouse (shipping or order confirmation) or at the latest when the goods are delivered.
b. Ordering process
The purchase contract is concluded with AFG Healthcare GmbH . In the overview of the range of the online shop hi1-golf.com the customer can select the desired product(s) by clicking on the button "Add to cart". The selected products will be displayed during the customer's visit to the website hi1-golf.com temporarily stored in the shopping cart. By clicking on the "Checkout" button next to the goods listed in the shopping cart, the order process is continued. On the next page, the customer is asked to log in to the online shop if he already has an account, or to register or to visit as a guest. The customer then selects the billing address he wants, then the shipping method he wants and then the delivery address he wants. The customer then selects the payment method he wants and enters the data required to make the payment. If external payment services such as PayPal are selected, the customer is redirected to the external website of the respective payment service provider. Before placing the order, the data relevant to the order is summarized in an "order overview". The customer is free to check his details in the order overview again and correct them if necessary before sending his order to the AFG Healthcare GmbH . By clicking on the button “Buy now”, the customer submits a binding offer to purchase the goods he has selected.
c. Order confirmation
After receipt of the order, AFG Healthcare GmbH will send a notification email to the email address provided by the customer, confirming receipt of the order and reproducing its contents (hereinafter referred to as “order confirmation”). The order confirmation does not constitute acceptance of the customer’s purchase offer by AFG Healthcare GmbH . If the If AFG Healthcare GmbH refuses to conclude a contract, the customer will be informed immediately by email.
d. Subscription Policies
Some items in our store are offered to you as part of a subscription. This cancellation policy explains how you can change or cancel these types of purchases.
Subscriptions:
When you purchase a subscription, you will receive recurring deliveries based on the duration and frequency of the subscription you choose.
Your payment details will be stored securely and you will be charged for each such delivery.
Some subscriptions may automatically renew at the end of their term. If you do not wish to renew a subscription, you can cancel it.
If you would like to cancel or change your subscription, you can do so at any time. Your order confirmation emails will contain links to your order. From there, you can manage your subscription. You can also contact our customer support team to change or cancel your subscription.

You can cancel a partially paid pre-order that has not yet been fulfilled. If the order has already been fulfilled, you cannot cancel the order, but you can request a full or partial refund. For more information on returns and refunds, see our cancellation policy .
4. Storage of the contract text
The contract text, i.e. the customer's details regarding the ordering process, is provided by the AFG Healthcare GmbH stores the data and can be viewed by the customer under the link “My Account” and “My Orders”. Irrespective of this, AFG Healthcare GmbH will send an order confirmation and these General Terms and Conditions to the email address provided by the customer.
5. Prices
- All prices are total prices; they include packaging costs and statutory sales tax (VAT). In the case of a subscription, the prices depend on the duration and frequency of the subscription you have chosen.
- In addition to the stated product prices, shipping costs will be added.
6. Delivery conditions
We only deliver by post. Unfortunately, it is not possible to collect the goods yourself. We do not deliver to packing stations. Deliveries are possible to delivery addresses in Austria. Unless otherwise agreed, delivery will be made to the address provided by the customer. Delivery will be made immediately. If the goods are damaged during transport, the customer must immediately report the damage to the transport company and claim the damage there. AFG Healthcare GmbH is not responsible for delivery obstacles on the part of suppliers or manufacturers. If delivery or compliance with an agreed delivery time is impossible due to circumstances beyond the control of AFG Healthcare GmbH is not responsible for the AFG Healthcare GmbH is entitled to withdraw from the contract in whole or in part. AFG Healthcare GmbH will inform the customer immediately in this regard. Claims for damages are excluded in this case.7. Due date and retention of title
- The purchase price is due before delivery of the goods.
- The delivered goods remain the property of AFG Healthcare GmbH .
8. Terms of payment
- AFG Healthcare GmbH accepts the following payment methods: PayPal, credit card (Visa, Mastercard) and instant bank transfer.
- When paying by credit card, your credit card will only be charged after the order has been completed. Please note: In order to pay by credit card in the AFG Healthcare GmbH online shop, the credit card must be activated for the 3D Secure process. You can obtain more information about this from your credit card company.
- Paypal - You pay the invoice amount via the online provider PayPal. You must be registered there or register first. After legitimizing yourself with the access data, you can confirm the payment instruction to us. You will receive further information during the ordering process.
- Sofortüberweisung - The purchase price will be debited from your account when the order is completed.
- The statutory regulations on default apply. Reminder costs for the appropriate enforcement or collection of the claim are shown separately in the invoice and can be claimed from the second reminder onwards.
9. Customs duties
If you order products from us and have them delivered to a country outside the EU, import duties and/or taxes may apply. These will be charged to you as soon as the package reaches its destination. Any additional fees incurred during customs clearance must be borne by you. We have no influence on these fees. Customs regulations vary greatly from country to country. Please contact your local customs authority for more information before ordering from us. Please note that when ordering, you will be considered the importer and must comply with all laws and regulations of the country into which you are importing our products. 10.1. CANCELLATION POLICY
As a consumer, you have a statutory right of withdrawal when concluding a distance selling contract, which we would like to inform you about as follows:
Right of withdrawal
You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period shall be thirty days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of a declaration (e.g. a letter sent by post, fax or e-mail).
You may use the attached sample cancellation form, although this is not mandatory.

Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.
If you exercise your legal right of cancellation for several goods ordered and only for part of the goods, you must bear the costs of sending them back to the amount that would have been incurred had you only ordered the goods that remained with you. For this refund, we will use the same means of payment that you used for the original transaction unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return the goods promptly and in any event no later than thirty days from the date on which you notify us of the cancellation of this contract to

The deadline is met if you send the goods before the expiry of the thirty-day period. We would like to point out that cancellation or withdrawal rights are excluded if, in the case of sealed goods, the seal was damaged and/or removed after delivery.
In the event of cancellation, you will bear the direct costs of returning the goods; this applies to returns within Austria and in particular to returns from abroad; here too, you will bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

10.3. RECOGNITION
A declaration of revocation is only possible by means of a clear declaration (e.g. letter, fax, e-mail) (see the legal model above).10.4. COST BEARING
If you make use of your right of withdrawal, you as a consumer will bear the regular costs of returning the ordered goods.11. Warranty
- Unless otherwise specified, the general statutory warranty provisions apply; your rights in the event of material and legal defects are therefore determined by the statutory provisions. We accept no liability for descriptions by third parties, in particular by customers in the context of published customer reviews.
- The warranty is excluded for defects caused by the customer. This is particularly the case in the case of improper handling.
- If delivered items show obvious material or manufacturing defects (including transport damage), the customer/orderer will notify us immediately.
- If a manufacturer's guarantee exists, the customer must assert any claims arising from this directly against the manufacturer. The liability of the AFG Healthcare GmbH in the context of a warranty claim is excluded; contractual guarantees are provided by AFG Healthcare GmbH is not granted.
- Your statutory right of cancellation and rights arising from any manufacturer's warranty declarations that may have been issued separately or included with the goods remain unaffected in all cases.
12. Liability and Disclaimer
Almost all of the products offered on this website are food supplements/foods for special medical purposes (balanced diet). When taking them, responsible use is crucial to avoid side effects. This particularly applies to adhering to the recommended intake and dosage. Furthermore, known intolerances to certain ingredients must also be taken into account before taking them. 13. Force Majeure
If we are prevented from fulfilling the obligations arising from a distance contract due to force majeure or circumstances beyond our control, AFG Healthcare GmbH assumes no liability.14. Right of set-off, right of retention
- The customer is not entitled to offset against our claims unless the customer's counterclaims have been legally established or are undisputed. The customer is also entitled to offset against our claims if he asserts complaints about defects or counterclaims from the same purchase contract.
- The customer may only exercise a right of retention if his counterclaim is based on the same purchase contract.
15. Data Protection
We take the protection of your personal data very seriously and treat your personal data confidentially and in explicit compliance with normative data protection regulations. Personal data is basically information with which a person can be identified and contacted. We receive and store your personal data when you contact us, fill out forms, are active on our website, shop with us, sign up for our e-newsletter and submit a product or other review.We collect and store (process) this personal data because it is necessary to answer your questions, inform you and process your orders correctly. 16. Changes to the Terms and Conditions / Right to Change
We are entitled to change these terms and conditions unilaterally if this is necessary to eliminate any subsequent equivalence problems or to adapt to changed legal or technical conditions. We will inform the customer of any changes by sending the content of the changed regulations to the customer's last known email address. The change will become part of the contract if the customer does not object to its inclusion in the contractual relationship in writing or text form within six weeks of receiving notification of the change.
